{"id":4636,"date":"2015-11-11T15:33:27","date_gmt":"2015-11-11T15:33:27","guid":{"rendered":"https:\/\/plumconsulting.co.uk\/?p=4636"},"modified":"2019-04-11T15:34:52","modified_gmt":"2019-04-11T15:34:52","slug":"telecommunications-en-nouvelle-zelande-une-politique-sur-la-bonne-voie","status":"publish","type":"post","link":"https:\/\/plumconsulting.co.uk\/fr\/telecommunications-en-nouvelle-zelande-une-politique-sur-la-bonne-voie\/","title":{"rendered":"T\u00e9l\u00e9communications en Nouvelle-Z\u00e9lande : une politique sur la bonne voie"},"content":{"rendered":"<p>La Nouvelle-Z\u00e9lande s&#8217;est engag\u00e9e \u00e0 investir dans la fibre en s&#8217;appuyant sur un financement public, avec une nouvelle extension de la fibre optique pr\u00e9vue et des objectifs nationaux en mati\u00e8re de haut d\u00e9bit, annonc\u00e9s le 6 octobre 2015.<\/p>\n<p>Atteindre ces objectifs de mani\u00e8re efficace et \u00e0 moindre co\u00fbt pour les finances publiques passera par l\u2019adoption d\u00e8s 2020 d\u2019une approche r\u00e8glementaire de la fibre qui soutienne l&#8217;investissement, ainsi qu&#8217;une approche tarifaire du cuivre et de la transition cuivre-fibre favorable \u00e0 l&#8217;investissement et, \u00e0 terme, au retrait du cuivre.<\/p>\n<p>Ce document pr\u00e9conise que le prix du cuivre soit stabilis\u00e9 et align\u00e9 au plus pr\u00e8s avec celui des produits de base de la fibre. Compte tenu des co\u00fbts, du temps et de l&#8217;incertitude li\u00e9s \u00e0 la r\u00e9vision du prix du cuivre, celui-ci devrait \u00eatre index\u00e9 (au moins) sur l&#8217;indice des prix \u00e0 la consommation, jusqu\u2019\u00e0 nouvel ordre. Cette approche simple favoriserait l&#8217;investissement dans la fibre, la migration du cuivre vers la fibre et, \u00e0 terme, \u00e0 la disparition du cuivre.<\/p>\n<p>En ce qui concerne ce dernier point, nous proposons une approche permissive laissant \u00e0 Chorus le soin de d\u00e9cider, sous r\u00e9serve d&#8217;un pr\u00e9avis minimal (la FCC a r\u00e9cemment propos\u00e9 un pr\u00e9avis de six mois pour le retrait du cuivre) et \u00e0 condition que les utilisateurs finaux ne soient pas p\u00e9nalis\u00e9s par le changement, ce qui serait rendu possible par le produit de r\u00e9f\u00e9rence propos\u00e9 durant la transition. Si certains clients utilisant les services historiques pr\u00e9f\u00e9raient une p\u00e9riode de transition plus longue, ils seraient libres de n\u00e9gocier une migration prolong\u00e9e sous certaines conditions commerciales.<\/p>\n<p>Notre \u00e9tude soutient \u00e9galement qu\u2019orienter la fibre en fonction des co\u00fbts peut s&#8217;av\u00e9rer controvers\u00e9 et complexe et ne permet pas de refl\u00e9ter l\u2019\u00e9valuation de la fibre par les consommateurs dans les d\u00e9cisions d\u2019investissement. Toutefois, si l\u2019on choisit ce type d\u2019orientation, mieux vaut privil\u00e9gier une m\u00e9thode ax\u00e9e sur le co\u00fbt consolid\u00e9 \u00e0 une m\u00e9thode ax\u00e9e sur le co\u00fbt incr\u00e9mental. Un plafond de revenus pourrait \u00eatre appliqu\u00e9 au cuivre et \u00e0 la fibre pour r\u00e9duire la complexit\u00e9 et faciliter la migration.<\/p>\n<p>En outre, apr\u00e8s analyse du d\u00e9groupage (passif) de la couche\u00a01 de la fibre, il semble que celui-ci supposerait d\u2019autres contreparties que le d\u00e9groupage du cuivre. En effet, le d\u00e9groupage de la fibre offrirait moins de possibilit\u00e9s d\u2019innovation par des tiers et \u00e9liminerait la diff\u00e9renciation des prix des services au niveau de la vente en gros (et donc \u00e9galement au niveau de la vente au d\u00e9tail, en raison des accords conclus pour le d\u00e9groupage de la couche\u00a01). Nous en concluons donc que le d\u00e9groupage de la couche\u00a01 n\u2019est pas d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.<\/p>\n<p>\u00c0 ce titre, plut\u00f4t que d\u2019opter pour une orientation en fonction des co\u00fbts et un d\u00e9groupage de la couche\u00a01, nous proposons une approche par prix de r\u00e9f\u00e9rence fixant en valeur r\u00e9elle, d\u00e8s 2020, le prix de la fibre d\u2019un d\u00e9bit de 30\/10 Mbps, et sugg\u00e9rons que cette vitesse de r\u00e9f\u00e9rence de 30\/10\u00a0Mbps soit appliqu\u00e9e \u00e0 tous les fournisseurs de fibre \u00e0 l&#8217;\u00e9chelle nationale. Ce produit constituerait un frein au poids abusif du march\u00e9 tout en offrant plus de flexibilit\u00e9 dans la sp\u00e9cification et la tarification de tous les autres niveaux de service.<\/p>\n<p>Pour soutenir encore davantage la transition cuivre-fibre, et afin que le prix de gros du cuivre reste inf\u00e9rieur \u00e0 celui de la fibre 30\/10 Mbps, nous sugg\u00e9rons de mettre \u00e0 disposition un produit de r\u00e9f\u00e9rence transitoire pour la fibre, \u00e0 un niveau de service et \u00e0 un prix correspondant \u00e0 l\u2019ADSL cuivre, soit environ 15\/1 Mbps. Une clause de temporisation pourrait \u00eatre rattach\u00e9e \u00e0 ce produit de r\u00e9f\u00e9rence transitoire.<\/p>\n<p>Enfin, nous proposons une d\u00e9marche qui soutienne, en mati\u00e8re de r\u00e9glementation, les accords volontaires \u00e0 long terme sur l&#8217;acc\u00e8s \u00e0 la vente de gros de la fibre. Ce type de contrats volontaires \u00e0 long terme (sur sept ans) a r\u00e9cemment vu le jour aux Pays-Bas. Ils pourraient se pr\u00e9senter sous la forme de tarifs \u00e0 double composante, pr\u00e9voyant une partie fixe et une partie d\u00e9gressive avec le temps.
